Welcome to Suntrudo AI. These Terms of Service and Policies ("Terms") govern your access to and use of the Suntrudo AI website, platform, application, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our Service.

1. Introduction and Platform Overview

Suntrudo AI is North Bengal's first indigenous artificial intelligence platform, designed and developed by Saiyam Kumar Dubey, operating from Malbazar, District Jalpaiguri, West Bengal, India. Our Service provides AI-powered assistance for educational purposes (including NCERT curriculum support), travel intelligence specific to the Dooars and North Bengal region, creative content generation, and general queries.

Our mission is to democratize access to advanced artificial intelligence while maintaining a deep understanding of Indian geography, culture, and educational systems.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. You represent and warrant that you are of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Service and gotten your parent or guardian to agree to these Terms on your behalf).

3. User Accounts and Registration

To access certain features of Suntrudo AI, you must register for an account using Google Firebase Authentication or your email address.

• Account Security: You are responsible for safeguarding the password and credentials that you use to access the Service. You agree not to disclose your password to any third party.
• Account Accuracy: You must provide accurate and complete information when creating an account.
• Unauthorized Access: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account by contacting our support team at dubeysaiyam4@gmail.com.

4. Acceptable Use Policy

You agree not to use the Service in any way that causes, or may cause, damage to the Service or impairment of the availability or accessibility of the Service. You must not use the Service:

• In any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity under the Information Technology Act, 2000 (India) or applicable international laws.
• To generate, disseminate, or promote content that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• To generate instructions on how to create weapons, illegal substances, or engage in dangerous activities.
• To copy, store, host, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, or other malicious computer software.
• To conduct any systematic or automated data collection activities (including scraping, data mining, data extraction, and data harvesting) on or in relation to our Service without our express written consent.

5. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Saiyam Kumar Dubey and its licensors. The Service is protected by copyright, trademark, and other laws of India and foreign countries.

AI-Generated Content: When you use Suntrudo AI to generate text or information ("Output"), you are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute that Output for your personal or commercial purposes, provided your use complies with these Terms. However, you acknowledge that due to the nature of machine learning, Output may not be unique across users, and the Service may generate the same or similar output for other users.

User Input: By submitting queries, prompts, or text ("Input") to the Service, you represent that you own or have the necessary rights to use that Input. You retain ownership of your Input.

6. Educational and Informational Use Disclaimer

Suntrudo AI is a tool designed to assist users with educational topics, travel planning, and creative writing. However, artificial intelligence can occasionally generate incorrect, incomplete, or misleading information ("hallucinations").

• Academic Use: While our AI is optimized for the Indian NCERT curriculum, students should verify important academic information against official textbooks or teachers. Suntrudo AI is a supplementary tool and should not be the sole basis for examination preparation.
• No Professional Advice: The Output generated by Suntrudo AI does not constitute professional medical, legal, financial, or psychological advice. Always seek the advice of qualified professionals regarding such matters.

7. Third-Party Services

Our Service relies on third-party platforms to function effectively, including Google Firebase for authentication and database management, and Cloudflare for edge computing and security. Your use of Suntrudo AI is also subject to the terms of service of these respective third-party providers. We are not responsible for any downtime, data loss, or issues caused directly by failures in these third-party services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Suntrudo AI, its developer, affiliates, agents, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Service.

Under no circumstances will Suntrudo AI be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account or the information contained therein.

9. Indemnification

You agree to defend, indemnify, and hold harmless Suntrudo AI and its developer, contractors, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; or (d) any claim that your use of the Service caused damage to a third party.

10. Modifications to the Service and Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

We also reserve the right to modify, suspend, or discontinue the Service (or any part thereof) temporarily or permanently, with or without notice to you. You agree that Suntrudo AI shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request data deletion.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, specifically the Information Technology Act, 2000, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any disputes or claims arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Jalpaiguri, West Bengal, India.
